The extraordinary situation caused by the COVID-19 pandemic and the subsequent state aid measures to support the economy have also affected Act No. 315/2016 Coll. on the Register of Public Sector Partners and on amendments to certain acts (hereinafter referred to as the “RPVS Act”).

Act No. 66/2020 Coll. , effective from 04.04.2020, Act No. 5/2004 Coll. on Employment Services (hereinafter referred to as Act No. 5/2004 Coll.) is also amended, which also stipulates that in the implementation of projects to support the maintenance of employment pursuant to Section 54(1)(e) , an exception to the obligation to register in the register of public sector partners under the RPVS Act is established in order to simplify and speed up the provision of assistance to employers and self-employed persons affected by the current pandemic crisis.
The above is directly enshrined in Section 72am of Act No. 5/2004 Coll. on employment services:
“For employers who receive a contribution under projects pursuant to Section 54(1)(e) and who must be registered in the register of public sector partners, the obligation to register in the register of public sector partners shall be deemed to have been fulfilled by 31 December 2020.”
These are various projects aimed at supporting job retention, including jobs in which self-employment is carried out or operated, and supporting the retention of employees in employment in connection with the situation caused by the COVID-19 pandemic and its consequences.
In connection with the above, we would like to point out that this does not affect the obligations to register in the RPVS arising from other legal regulations, such as the Act on the RPVS, Act No. 343/2015 Coll. on public procurement and on amendments to certain laws, etc., i.e. if, for example, a commercial company meets the conditions for registration in the RPVS pursuant to Section 2 of the RPVS Act, it must be registered as a public sector partner in the register of public sector partners.
