The external registrar is to allow attorneys and notaries to file applications with the Commercial Register in person.
The Commercial Register is a public registry in which information prescribed by law is recorded and which includes a collection of documents required by law. As of October 1, 2020, both the Commercial Register and the Collection of Documents operate exclusively electronically, meaning that any submissions are only admissible in electronic form and via the designated forms. Similarly, all necessary attachments must be submitted electronically. This is undoubtedly a step that has simplified communication with the registry courts; nevertheless, the registry courts remain overburdened, often to the point where they simply cannot keep up with their workload. A forthcoming amendment drafted by the Ministry of Justice, whose proposal was approved on July 21, 2021, should help; its aim is to ensure transparency, modularity, accessibility, ease of navigation, and uniformity across the entire commercial register. This amendment envisages several fundamental changes, including, for example, reducing the total number of registry courts from the current eight to one, but most notably the introduction of so-called external registrars. In specific matters, external registrars will be attorneys and notaries, to whom individuals will be able to submit applications to the Commercial Register in person. This should result in greater convenience for clients of the Commercial Register, faster registration, and a reduction in the workload of the registry courts. The amendment is scheduled to take effect on January 1, 2023
