The Czech Office for Personal Data Protection has launched an investigation into the provider of an online COVID-19 vaccination booking system. This action was taken in response to complaints received that raise serious suspicions of legal violations by the platform https://reservatic.com/ockovani.
According to information from the Ministry of Health of the Czech Republic and the National Agency for Communications and Information Technology, the birth numbers of insured individuals were allegedly transmitted unsecured to the U.S. via cookies. This personal data was subsequently transferred to the Google Analytics system and shared with Google.
Transfers of Personal Data to Third Countries or International Organizations
The subject of the Authority’s investigation will be an assessment of the lawfulness of transferring personal data to the United States, which, from a data protection perspective, is classified as a third country.
Pursuant to Article 44 of the GDPR, such a transfer to a third country or an international organization may take place only if the controller and the processor comply with the conditions so as not to compromise the level of protection of natural persons guaranteed by the Regulation.
The Authority’s investigation will also include verifying whether the conditions arising from the European Court of Justice’s judgment annulling the Privacy Shield (Privacy Shield), on the basis of which the U.S. does not guarantee an adequate level of personal data protection.
Jiří Kaucký, Chairman of the Office for Personal Data Protection in the Czech Republic, also issued a statement: “We will verify how the personal data of Czech citizens who register through the Central Reservation System for COVID-19 Vaccinations is handled, and whether this handling of personal data complies with the General Data Protection Regulation.”
The Czech Office for Personal Data Protection will inform the public of the results of the investigation at a later date.
