A few days ago, the Czech Office for Personal Data Protection published a press release containing a list of the most common mistakes related to cookie settings.
As of February 1, 2022, the new Act No. 452/2021 Coll. on Electronic Communications (or, more precisely, most of its provisions) has entered into force, transposing into Slovak law Directive (EU) 2018/1972 of the European Parliament and of the Council (EU) 2018/1972 of December 11, 2018, which establishes the European Electronic Communications Code, into Slovak law.
Following this directive, not only Slovakia but also other EU countries were required to amend their legislation in the field of electronic communications, which includes regulations on cookies. In Slovakia, the division of responsibilities in this area between the Office for Personal Data Protection and the Office for the Regulation of Electronic Communications and Postal Services has not yet been clarified. In the Czech Republic, our neighbor, the Office for Personal Data Protection is responsible for monitoring compliance with legislation in this area; in the first half of 2022 alone, it conducted several inspections focused in part on cookies.
Following these inspections, the Office identified and published the most common violations in a press release. According to the press release from the Czech Office for Personal Data Protection, these violations include:
- Use of non-technical cookies without consent
- Excessively long cookie expiration periods relative to their purpose
- Lack of an option to opt out of the use of non-technical cookies in the first layer of the cookie banner
- Incorrect categorization of cookies
- Lack of information about the specific cookies used
- Difference in the visibility of buttons for consenting to and objecting to the use of non-technical cookies
- Incorrect classification of cookie files
- Cookie information in a foreign language
- The cookie banner makes it difficult or impossible to read the website
